BROOKLYN and its parents, subsidiaries, and affiliated entities ("we", "us" or "our") respect your concerns about privacy and value the relationship we have with you. We are committed to protecting it through our compliance with this privacy policy ("Privacy Policy" or "Policy").

This Privacy Policy describes the types of personal information we collect about our users and customers and how we use and disclose personal information about individuals who use our website (brooklynmx.com) and all corresponding webpages, software applications, or ordering pages powered by that link to this Privacy Policy (collectively, the "Site") or who otherwise interact with us online or offline (collectively, our "Services"). Do Not Track Signals

Some internet browsers include the ability to transmit "Do Not Track" or "DNT" signals. Since uniform standards for "DNT" signals have not been adopted, our Site does not currently process or respond to "DNT" signals sent by browsers, mobile devices, or other mechanisms.

4. How Long We Keep Personal Information

The categories of personal information we may share for targeted/cross-context behavioral advertising or otherwise "sell" for non-monetary consideration can include:

The types of third parties to which personal information may be sold or shared are third-party advertisers and some analytics vendors. We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age.

6. California Privacy Rights

This section supplements the other parts of our Policy and provides disclosures for California residents under the California Consumer Privacy Act (the "CCPA").

Right to Know

California residents have the right to request more information regarding the following:

Upon receipt of a verifiable request to correct inaccurate personal information, we will use commercially reasonable efforts to correct the information as you direct.

Right to Opt Out

If you choose to use a browser-based opt-out signal, you will be opted out of cookie-based sales or sharing of personal information and may need to turn it on for each browser you use. Right to Limit Use and Disclosure of Sensitive Personal Information

We do not use sensitive personal information for purposes to which the right to limit use and disclosure applies under the CCPA.

Submitting Requests Relating to Your Personal Information

To exercise your right to know, right to delete, or right to correct under the CCPA, please contact us using the information at the bottom of this Privacy Policy. Please note that if you submit a request, you will be asked to provide pieces of personal information that we will match against our records to verify your identity. You may designate an authorized agent to make a request on your behalf; however, you may still need to verify your identity directly with us before your request can be processed.

Right to Non-Discrimination for the Exercise of Your Privacy Rights

If you choose to exercise any of your privacy rights under the CCPA, you also have the right not to receive discriminatory treatment by us.

California’s Shine the Light Law

California residents may request a list of the third parties to which we have disclosed personal information, as defined under California Civil Code Section 1798.83(e), during the preceding calendar year for third-party direct marketing purposes. To make such a request, please write to us using the contact information provided at the end of this Policy and specify that you want "The California Shine the Light Notice."

7. Privacy Rights for Consumers in Covered States Outside California

If you are a consumer who lives in Colorado, Connecticut, Oregon, Texas, Utah or Virginia, you have the right to submit certain requests relating to your personal information as described below.

Order Terms

These Order Terms apply when you place orders through restaurant or business websites, online ordering pages, or QR menus powered by BROOKLYN. While BROOKLYN provides the technology platform, the restaurant or merchant is responsible for preparing and fulfilling your order. Where these terms refer to "we", "us" or "our" in the context of an order, it typically refers to the restaurant or merchant fulfilling the order, unless otherwise stated.

Cancellation / Refund / Return Policy

We want you to be satisfied with your order. The following sections describe how order cancellations, refunds, and returns are typically handled by restaurants using BROOKLYN. Individual restaurant policies may vary and may be communicated on their own site or at checkout.

A. Order Cancellation

You generally have the ability to update or abandon your order at any time prior to completing payment and submitting the order. Once an order is placed, paid, and confirmed by the restaurant, the preparation process usually begins immediately. Because of this, restaurants often cannot accept cancellations of any orders once they have been confirmed.

If you need to request a cancellation after placing an order, you should contact the restaurant directly as soon as possible using the contact information provided on their site or in your confirmation message. Whether a cancellation or refund is granted at that stage is at the restaurant’s discretion and subject to their policies.

B. Refunds and Returns

If you receive an order that has missing items, wrong items, or unsatisfactory items, please contact the restaurant directly. The restaurant is responsible for the quality, preparation, and accuracy of your order.

Any refunds, credits, or order adjustments are typically processed by the restaurant. When a refund is granted, it will usually be processed via the payment method used to place the order. Delivery Policy

A. General Information

All orders are subject to product availability. If an item is not in stock or cannot be prepared at the time you place your order, the restaurant may contact you to offer substitutions, remove the item from your order, or cancel the order, depending on the circumstances and their policies.

B. Delivery Area

Items offered on restaurant websites or online ordering pages powered by BROOKLYN are only available for delivery to addresses within each restaurant’s specified delivery area. The delivery area is usually defined by a fixed radius or specific zones. You may be prompted to enter your address to check whether you are in the delivery zone before you place an order.

C. Delivery Time

An estimated delivery time may be provided to you once your order is placed and confirmed. Unless there are exceptional circumstances, restaurants and their delivery partners make reasonable efforts to deliver your order within the estimated timeframe. However, actual delivery times may vary due to factors such as order volume, traffic, weather, and other operational constraints.

D. Delivery Date

E. Delivery Fee

F. Delivery Instructions

The restaurant and/or delivery partner will attempt to follow reasonable instructions, but cannot guarantee that all instructions can be accommodated in all circumstances.

G. Questions about Your Order or Delivery
